In this article, we will analyze the origins of the German Constitution from the beginning of the Federal Republic. Constitutional history has developed two main lines of interpretation regarding this period: first, one that focuses on the role of the Freiburg School and ordoliberal thought; second, one that focuses on the social-democratic turn of the Frankfurt School in response to the crisis of socialism. Third, however, it is necessary to consider the development of the reactionary thought of Forsthoff, Gehlen, and Schelsky in political theory, and its consequences for the problem of biopolitics.
