This work aims to analyze the jury system from a democratic perspective, seeking to demonstrate its necessity for the very validation of the democratic rule of law. The purpose of this work was to revisit the institution in order to highlight its importance as an instrument of popular participation. The direct participation of society in the jury system was analyzed, delving into the issue related to the jurors' veto power in the American system. It is also important to add that this work addresses the constitutional analysis of the jury system, its legitimacy and its democratic vocation, using the American jury model as an ideological guide and the social contract theory as a philosophical basis, understanding the jury as an instrument for protecting society against state supremacy and its hierarchical power structure.
