The people of droughts and the right to development

a process of legal legitimation

Abstract

Humans, as both object and subject of their own transformations, have undergone various processes, always in search of a better quality of life. Since their existence, they have sought coexistence with others to facilitate this and the realization of their goals. Throughout history, the institutionalization of rights inherent to the individual, considered both individually and collectively, has contributed to improving the relationship between individuals and between them and the State, which will play a positive or negative role, depending on the situation. However, people living in areas with unfavorable climatic conditions have not been treated in a way that allows them to overcome such adversities, nor have their right to development been guaranteed. This study will point out some solutions to guarantee the basic right of people living in drought-affected areas to be legitimate subjects of rights, as determined by the Brazilian legal system.
