A possibilidade de derrogação de direitos humanos no sistema interamericano

O presente artigo analisa a possibilidade da suspensão temporária de direitos humanos em situações de emergência admitida pela Convenção Americana sobre Direitos Humanos. Em especial, são analisadas as três hipóteses nas quais a Convenção admite a derrogação de algumas das garantias fundamentais nela previstas: os casos de “guerra”, de “perigo público” e de “outra emergência que ameace a independência ou segurança do Estado Parte”. A análise é feita através do exame do texto da Convenção e de seus trabalhos preparatórios, da comparação com outros instrumentos de direitos humanos e dos entendimentos da Comissão e da Corte Interamericana de Direitos Humanos a respeito do tema. O artigo observa que os órgãos do Sistema Interamericano de Direitos Humanos consideram a observância do sistema democrático como um requisito adicional para se determinar a legalidade da suspensão de garantias da Convenção, concluindo que este requisito busca evitar abusos na utilização do instrumento pelos países da América Latina.
