Abstract

This article aims to respond to the problem of knowing, in terms of due criminal process, including criminal guarantees (substantial and procedural), what is the role of the judge in prosecuting and judging environmental crimes, in case of doubt and other procedural situations. To this end, the thesis is defended that the role of the judge does not change, in light of the need to implement criminal and criminal procedural guarantees, due to the fact that he is judging environmental crimes.
