La possibilité de dérogation aux droits de la personne dans le système interaméricain

Cet article analyse la possibilité de suspendre temporairement les droits de la personne en cas d'urgence, conformément à la Convention américaine relative aux droits de l'homme. Il examine plus précisément les trois scénarios dans lesquels la Convention autorise la dérogation à certaines de ses garanties fondamentales : les cas de « guerre », de « danger public » et d'« autres situations d'urgence menaçant l'indépendance ou la sécurité de l'État partie ». L'analyse repose sur l'étude du texte et des travaux préparatoires de la Convention, une comparaison avec d'autres instruments relatifs aux droits de la personne et l'interprétation de la Commission et de la Cour interaméricaines des droits de la personne sur ce sujet. L'article constate que les organes du Système interaméricain des droits de la personne considèrent l'adhésion au système démocratique comme une condition supplémentaire à l'appréciation de la légalité de la suspension des garanties de la Convention, et conclut que cette exigence vise à prévenir les abus dans l'utilisation de cet instrument par les pays d'Amérique latine.
