The rebus sic stantibus clause in light of Aristotelian commutative justice.

The rebus sic stantibus clause, enshrined in Brazilian law, has a strict principled relationship with commutative justice, as developed by Aristotle (384 BC-322 BC), especially regarding teleology. The theory of unforeseen circumstances aims to promote justice in contractual relationships when circumstances change, in view of the balance of benefits and losses for the parties. This study, using a hypothetical-deductive method, supported by expositors of Aristotelian legal-philosophical doctrine and the history and application of the rebus sic stantibus clause, aims to analyze the issues, in their philosophical assumptions and historical context, in order to find convergences and influences. It concludes that there is a clear relationship between the basic elements of the institutions, which have the same purpose, although it is not possible to definitively affirm the historical link of influence of Aristotelian doctrine in the emergence of the clause.
